Our attorneys have had tremendous success in defending claims against apartment owners and premises owners against claims of negligent security. In Bonilla v. Hull[*66] Ernest Peck obtained a dismissal of the action against the building owner and manager in a claim of improper security wherein the plaintiff alleged sexual assault by an intruder in the building. By presenting records from the New York City Police Department and our own client's documentary proof, Mr. Peck refuted various theories of liability argued by plaintiff and established that there was no breach of security and no prior notice of criminal activity in the building. This decision was affirmed after oral argument by Mr. Peck in the Appellate Division, 2nd Department.
